Welcome to ElevateHome.ai ("ElevateHome," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the ElevateHome.ai website, applications, APIs, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.
1. What ElevateHome Does
ElevateHome is a direct-mail marketing platform designed for pool, landscape, roofing, and driveway contractors and the marketing agencies that serve them. We identify residential properties matching contractor-selected criteria, generate AI-rendered "before / imagine" postcard visuals of those properties, and mail printed postcards to those addresses on behalf of the contractor. Contractors pay a monthly subscription based on the number of homes mailed.
2. Eligibility & Account Registration
You must be at least 18 years old and legally authorized to enter into contracts to use the Services. When you register an account, you agree to provide accurate, current, and complete information (business name, contact details, service address, license number where applicable) and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. Subscriptions, Billing & Cancellation
- Monthly billing. Subscriptions are billed monthly in advance via Stripe. Pricing is based on the number of homes you elect to have mailed per month within your chosen ZIP codes.
- Automatic renewal. Your subscription automatically renews each month at the then-current price until you cancel.
- Cancellation. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing cycle; no refunds are issued for partial months.
- Failed payments. If your payment method fails, we may pause your campaign until payment is resolved. Repeated failures may result in account suspension.
- Price changes. We may change subscription pricing with at least 30 days' notice to your account email. Continued use after the effective date constitutes acceptance of the new price.
4. Contractor Content & Approval
You may configure the copy printed on your postcards (business name, phone number, license number, headline, offer text, and other elements). You are solely responsible for the accuracy and legality of that content, including compliance with state and local contractor-advertising rules, license-display requirements, and any offer or promotional-code disclosures. Where applicable, you must review and approve each AI-generated render before it is mailed. By approving a render, you authorize ElevateHome to print and mail the postcard as displayed.
5. AI-Generated Content Disclaimer
Postcards produced through the Services include renderings generated by artificial-intelligence systems using satellite imagery and text prompts. These renderings are illustrative marketing visuals only. They do not represent architectural plans, structural proposals, engineering drawings, permit-ready designs, or any promise of a specific project outcome. You may not represent AI renderings as accurate depictions of a specific property's future condition, planned work, or completed project.
6. Direct Mail & Recipient Data
- Mailing addresses are sourced from third-party property-data providers and are delivered via USPS through our mailing partner (Lob, Inc.).
- You are responsible for complying with all applicable laws governing direct mail advertising in the jurisdictions where you send postcards, including any state or local do-not-mail lists, prevailing-wage disclosures, or contractor advertising rules.
- ElevateHome maintains its own suppression list of addresses that have opted out through us and will not mail to those addresses.
- Delivery timing depends on USPS. We do not guarantee delivery within a specific window.
7. Affiliate / Agency Program
Marketing agencies may enroll in our Affiliate Program to earn a commission on contractor subscriptions they refer through their unique referral link. Commission rates and terms are described on the Affiliate Program page and may be updated with notice. Commissions are paid monthly via ACH. ElevateHome reserves the right to withhold or reverse commissions for referrals determined to be fraudulent, self-referred, or otherwise in violation of these Terms.
8. Prohibited Uses
You agree not to use the Services to:
- Advertise services you are not legally licensed to perform in the target jurisdictions.
- Mail deceptive, misleading, defamatory, or fraudulent content.
- Attempt to scrape, reverse-engineer, or reproduce the Services, our AI models, or our property data.
- Circumvent rate limits, quotas, or usage restrictions.
- Mail to specific individuals for purposes other than good-faith commercial home-services solicitation.
9. Intellectual Property
ElevateHome retains all rights to the platform, our AI rendering pipeline, our website, our brand, and our proprietary systems. You retain rights to the business name, logo, license, and other information you supply. AI-generated postcard visuals produced for your campaigns are licensed to you on a non-exclusive, non-transferable basis for use in the campaigns you have paid for. You may not resell, redistribute, or sublicense these visuals outside of your ElevateHome campaigns.
10. Third-Party Services
The Services rely on third-party providers including Stripe (payments), Lob (postcard printing and USPS delivery), PropertyRadar (property data), Google (maps and geocoding), and OpenAI (AI rendering). Your use of the Services is also subject to the terms of these providers where applicable. We are not responsible for outages, errors, or actions of third-party providers, but we will make reasonable efforts to select reliable partners and address issues that arise.
11. Warranties & Disclaimer
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant any specific response rate, lead-generation outcome, project-conversion rate, or return on investment from campaigns. Marketing results depend on many factors outside our control.
12. Limitation of Liability
To the maximum extent permitted by law, ElevateHome's total liability to you for any claim arising from these Terms or the Services is limited to the amount you paid us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost revenue, even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless ElevateHome, its officers, employees, and partners from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: (a) the content you supply for your postcards; (b) your use of the Services in violation of these Terms or applicable law; (c) your business practices, contractor licensing, or the work you sell to homeowners; or (d) any misrepresentation made in materials you approve for mailing.
14. Termination
You may cancel your subscription at any time. We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, misused the Services, or created legal or reputational risk. Upon termination, your right to use the Services ends immediately; already-paid but unfulfilled campaigns will either be completed or refunded on a prorated basis at our discretion.
15. Modifications to These Terms
We may update these Terms from time to time. Material changes will be announced by email or through the Services. Continued use after the effective date of updated Terms constitutes acceptance of the changes.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Oakland County, Michigan, and you consent to personal jurisdiction there.
